Separation of powers is a political doctrine originating in the writings of Charles de Secondat, Baron de Montesquieu in The Spirit of the Laws , in which he argued for a constitutional government with three separate branches, each of which would have defined abilities to check the powers of the others.
The Constitution nowhere contains an express injunction to preserve the boundaries of the three broad powers it grants, nor does it expressly enjoin maintenance of a system of checks and balances. Yet, it does grant to three separate branches the powers to legislate, to execute, and to adjudicate, and it provides throughout the document the means by which each of the branches could resist the blandishments and incursions of the others. The Framers drew up our basic charter against a background rich in the theorizing of scholars and statesmen regarding the proper ordering in a system of government of conferring sufficient power to govern while withholding the ability to abridge the liberties of the governed. When the colonies separated from Great Britain following the Revolution, the framers of their constitutions were imbued with the profound tradition of separation of powers, and they freely and expressly embodied the principle in their charters.

RTF format. When certifying the Constitution, the Constitutional Court had to consider whether the new Constitution did indeed comply with this principle. In responding to challenges raised to the text of the Constitution the Court reasoned as follows: There is, however, no universal model of separation of powers, and in democratic systems of government in which checks and balances result in the imposition of restraints by one branch of government upon another, there is no separation that is absolute. While in the USA, France and the Netherlands members of the executive may not continue to be members of the legislature, this is not a requirement of the German system of separation of powers. Moreover, because of the different systems of checks and balances that exist in these countries, the relationship between the different branches of government and the power or influence that one branch of government has over the other, differs from one country to another.
Checks and balances , principle of government under which separate branches are empowered to prevent actions by other branches and are induced to share power. Checks and balances are applied primarily in constitutional governments. They are of fundamental importance in tripartite governments, such as that of the United States, which separate powers among legislative, executive , and judicial branches. The Greek historian Polybius analyzed the ancient Roman mixed constitution under three main divisions: monarchy represented by the consul ; aristocracy the Senate ; and democracy the people. He greatly influenced later ideas about the separation of powers. The British Parliament is supreme, and laws passed by it are not subject to review by the courts for constitutionality. In France, under the Fifth Republic , a Constitutional Council of nine members appointed for nine years by the president, Senate, and National Assembly reviews the constitutionality of legislation.

Checks and balances in the Constitution of the United States 2. The current global financial crisis has seen different governments taking similar steps in order to restore trust and confidence in the shaken financial system: vast, multi-billion bail-out plans. However, the celerity of the legislative implementation of these countermeasures differs greatly from country to country. A comparison of how these parliamentary acts passed the legislation in Germany and the United States provides an interesting insight into the functioning of the respective systems of government. Only four days later, on the 17th of October, both houses of the German parliament voted in favour of the plan Reuters, After his first proposal on the 19th of September, multiple revisions of the original plan were necessary until the bill passed Congress on the 3rd of October. This episode is indicative of the level of persuasion that goes into lawmaking in the US.

The Separation of Powers – Why Is It Necessary?
History has time and again shown that unlimited power in the hands of one person or group in most cases means that others are suppressed or their powers curtailed. The separation of powers in a democracy is to prevent abuse of power and to safeguard freedom for all. The system of separation of powers divides the tasks of the state into three branches: legislative, executive and judicial. These tasks are assigned to different institutions in such a way that each of them can check the others.
