Magna Carta

Magna Carta , English Great Charter , charter of English liberties granted by King John on June 15, , under threat of civil war and reissued, with alterations, in , , and Above all, the Magna Carta guaranteed that government, royal or otherwise, would be limited by the written law of the land. It was reissued again in , when the council reconsidered it clause by clause. The enduring influence of the Magna Carta comes not from its detailed expression of the feudal relationship between lord and subject but from its more-general clauses in which every generation can see its own protection. The right to petition and habeas corpus and the concept of due process are derived from language in the Magna Carta, which also was a forerunner of Parliament , the Declaration of independence , the U. Constitution , and the U. Bill of Rights.

That we wish this so to be observed, appears from the fact that of our own free will, before the outbreak of the present dispute between us and our barons, we granted and confirmed by charter the freedom of the Church's elections - a right reckoned to be of the greatest necessity and importance to it - and caused this to be confirmed by Pope Innocent III. This freedom we shall observe ourselves, and desire to be observed in good faith by our heirs in perpetuity. The first clause of Magna Carta guarantees the freedom of the English Church. This clause was specifically included to stop the king from interfering in what the Church did, and gave the Church the right to elect its own leaders, rather than have them chosen by the king. King John and the Pope had fallen out over the choice of the Archbishop of Canterbury before Magna Carta, and this first clause was intended to ensure that these problems did not happen again. The fact that this is the first clause is a reminder of the important part that the Church played in bringing Magna Carta about. It is also the reason that English Cathedrals guarded Magna Carta so carefully over the centuries.

Did she die in vain? On the one hand, for many, Magna Carta is alive and well. The alternative view is that Magna Carta has been reduced to nothing but a symbol; a crumbling relic, redundant at law and in practice. And Magna Carta embodied neither jury trial nor habeas corpus — both came later and over time. In reality, much of its text was pretty obscure and administrative — and, frankly, rather dull.

G iven that celebrated years since the creation of Magna Carta on 15 June , it was unsurprising that the event did not pass unmarked. What may be a little more surprising, perhaps, was the fact that there was quite so much commemoration and so many books dedicated to what is, in effect, a document of medieval legal historical interest. Naturally, the interest in Magna Carta is wide ranging, and the charter is credited for being the starting point for several major legal developments, among them the making of the jury of twelve for deciding legal cases; the first human rights document; the first step on the road to the American Declaration of Independence; and the making of the English constitution. Magna Carta: The Origin of Modern Human Rights

In Europe, assertions of individual rights evolved with the emergence of Nation-States. The Magna Carta, first issued in , was an early legal document that granted certain rights to the English nobility by the King. The Magna Carta was reissued in different forms and reinterpreted in England over several centuries.

In the context of human civilisation, years is a long time. King John needed revenue to finance his proposed new crusade. The barons felt they had been overtaxed and that the king had governed in a manner that had whittled away their ancient rights and privileges.

In , after King John of England violated a number of ancient laws and customs by which England had been governed, his subjects forced him to sign the Magna Carta, which enumerates what later came to be thought of as human rights. Among them was the right of the church to be free from governmental interference, the rights of all free citizens to own and inherit property and to be protected from excessive taxes. It established the right of widows who owned property to choose not to remarry, and established principles of due process and equality before the law. It also contained provisions forbidding bribery and official misconduct.
