Magna Carta , English Great Charter , charter of English liberties granted by King John on June 15, , under threat of civil war and reissued, with alterations, in , , and Above all, the Magna Carta guaranteed that government, royal or otherwise, would be limited by the written law of the land. It was reissued again in , when the council reconsidered it clause by clause. The enduring influence of the Magna Carta comes not from its detailed expression of the feudal relationship between lord and subject but from its more-general clauses in which every generation can see its own protection. The right to petition and habeas corpus and the concept of due process are derived from language in the Magna Carta, which also was a forerunner of Parliament , the Declaration of independence , the U. That we wish this so to be observed, appears from the fact that of our own free will, before the outbreak of the present dispute between us and our barons, we granted and confirmed by charter the freedom of the Church's elections - a right reckoned to be of the greatest necessity and importance to it - and caused this to be confirmed by Pope Innocent III. This freedom we shall observe ourselves, and desire to be observed in good faith by our heirs in perpetuity. The first clause of Magna Carta guarantees the freedom of the English Church. This clause was specifically included to stop the king from interfering in what the Church did, and gave the Church the right to elect its own leaders, rather than have them chosen by the king. King John and the Pope had fallen out over the choice of the Archbishop of Canterbury before Magna Carta, and this first clause was intended to ensure that these problems did not happen again. The fact that this is the first clause is a reminder of the important part that the Church played in bringing Magna Carta about. It is also the reason that English Cathedrals guarded Magna Carta so carefully over the centuries.

The alternative view is that Magna Carta has been reduced to nothing but a symbol; a crumbling relic, redundant at law and in practice. And Magna Carta embodied neither jury trial nor habeas corpus — both came later and over time. In reality, much of its text was pretty obscure and administrative — and, frankly, rather dull.

Naturally, the interest in Magna Carta is wide ranging, and the charter is credited for being the starting point for several major legal developments, among them the making of the jury of twelve for deciding legal cases; the first human rights document; the first step on the road to the American Declaration of Independence; and the making of the English constitution.
